On September 23, the Circuit Court rejected his plea to stay the decisions of other courts that had approved the State Department’s move to extradite him to India. On November 13, Rana filed a “petition for writ of certiorari” before the US Supreme Court.
This is Rana’s last legal chance in the long battle to avoid being extradited to India.
In his “Petition for Writ of Certiorari for Review of the Judgment of the United States Court of Appeals for the Ninth Circuit” in this case, Rana makes the same argument that he was sued in federal court in the Northern District of Illinois and that he Was acquitted (Chicago) on charges related to the 2008 terrorist attack on Mumbai.
“India now seeks his extradition to face trial on charges based on similar conduct in the Chicago case,” it said.
The petition said that if the “substantive” standard is applied, he would be sent to India to stand trial a second time for the same conduct, in which case conviction and the death penalty would be inauspicious for him. “Furthermore, resolution of this issue will have a substantial and growing impact, as the increasing globalization of criminal law enforcement and international cooperation, which has resulted in a dramatic increase in extraditions, will impact more and more individuals and nations going forward.” ” It said.
